Nizhny Novgorod, September, 2009. The Federal Arbitration Court of the Moscow District at a hearing on September 8, 2009 rejected a claim filed by the Regional Inspectorate # 7 of the Federal Tax Service of Russia for large taxpayers and dimissed an appeal filed by tax authorities against VolgaTelecom.
For the record, as a result of a claim launched against VolgaTelcom, the Moscow Arbitration Court of General Jurisdiction on January 28, 2009 invalidated levying additional taxes against the company. The company challenged over 99% of the alleged claims in terms of value. The court of second instance, the Ninth Arbitration Appeals Court, at a meeting on April 21, 2009 left unchanged the ruling of the Moscow Arbitration Court, and the appeal filed by the Regional Inspectorate # 7 of the Federal Tax Service of Russia for large taxpayers was rejected.
The decision to charge VolgaTelecom with tax liability for an alleged fiscal violation was adopted on April 30, 2008. The total amount of the claim filed by tax authorities amounted to Rub 173.314 mln, of which Rub 163.481 related to taxes and fees and Rub 9.833 mln to fines and penalties. The main claim was associated with issues involving payment for interconnect and traffic transmission.
